- General Terms and Conditions of Sale

FI-645406, VAT no. 00637070459, Share Capital € 1,000,000.00 fully paid, certified email (PEC): pec@pec.acquasancarlo.it (hereinafter also referred to as “San Carlo”), sets forth below the general terms and conditions of sale (hereinafter also referred to as “Terms and Conditions”) governing purchases made by the buyer (hereinafter also referred to as the “Customer”) of products via the website www.acquasancarlo.com, which is solely owned by San Carlo, and all resulting relationships between the seller and the purchasers of the products.

- Website and Product Delivery
These Terms and Conditions govern all transactions carried out by San Carlo through the website www.acquasancarlo.com. The Terms and Conditions regulate the purchase of products by the Customer in accordance with the applicable legislation, including, where relevant, Legislative Decree No. 206/2005 (the Consumer Code) and Legislative Decree No. 70/2003 concerning electronic commerce.
Products purchased through the website www.acquasancarlo.com are eligible for delivery exclusively within the territory of Italy.
The contract may be executed in either Italian or English.
- Consumer Code
The entry of a tax code at the time of purchase shall be deemed to indicate that the Customer is acting as a ‘Consumer’ pursuant to Article 3, paragraph 1, letter a) of the Consumer Code (Legislative Decree No. 206 of 6 September 2005). A “Consumer” is defined as a natural person acting for purposes unrelated to any entrepreneurial, commercial, professional, or craft activity.
Alternatively, the provision of a VAT number shall be understood as an indication that the purchase is being made as a “Professional”, as defined in Article 3, paragraph 1, letter c) of the Consumer Code. A “Professional” refers to any natural or legal person acting in the exercise of their entrepreneurial, commercial, craft, or professional activity, or an intermediary thereof.
- Products
The characteristics of each product are detailed on the corresponding product pages. All images are for illustrative purposes only and may not accurately represent the actual product.
Packaging is intended for single use and is non-returnable. Bottles, containers, and/or packaging are excluded from any return or exchange process.
- Prices
All prices are stated in euros and include VAT. Shipping costs are specified at the time of order and may vary depending on the destination and weight of the shipment.
Customers may apply promotional codes issued by San Carlo, subject to availability. Such codes must be entered in the designated field during the checkout process. Discounts granted through promotional codes apply exclusively to product prices and do not extend to shipping charges. The discount may be either a fixed amount or a percentage, as specified at the time of issuance of the promotional code.
Each promotional code shall bear a clearly indicate expiration date.
Product prices exclude shipping fees, which are calculated automatically and transparently displayed in the order summary prior to payment, as well as in any subsequent documentation.
For deliveries requested within the area between Bocca di Magra and Viareggio, shipping shall be free of charge only for orders totaling €75 or more (VAT included). Customers are required to contact San Carlo prior to placing the order to confirm delivery availability within this area.
- Orders
To place an order, the Customer must follow the procedure outlined on www.acquasancarlo.com, which entails accessing the “Buy” section via the button located at the top right of the page, selecting the desired product(s) and quantity, providing the required information, and completing payment by clicking the designated “Pay” button within the shopping cart.
The order process consists of the following stages: “Your Cart,” “Checkout Details,” and “Order Completed.” The purchase contract shall be deemed concluded only upon the successful completion of the order process and the receipt by the Customer of the order confirmation email issued by San Carlo.
The order confirmation shall include a summary of the contractual terms and conditions, essential product details, itemized pricing, payment methods, withdrawal rights, delivery charges, and applicable taxes.
By checking the box for acceptance of the Terms and Conditions and clicking the ‘Place Order’ button on the website www.acquasancarlo.com, the Customer expressly acknowledges and accepts these Terms and Conditions.
San Carlo shall retain a copy of the order and the corresponding order confirmation email within its records and shall provide a physical copy of the receipt or invoice accompanying the delivered products. The Customer may request a copy of the order by contacting San Carlo at info@acquasancarlo.it.
In the event of product unavailability, San Carlo will promptly notify the Customer to arrange for either a suitable replacement or a refund.
- Payment Methods
As indicated on the website, the sole accepted method of payment is as follows:
- Credit or debit cards issued by major international networks (e.g., Visa, Mastercard, American Express), provided that such cards are enabled for online transactions.
Payment is required at the time of order placement, in accordance with the instructions displayed on the website.
Shipment of the product shall occur only upon the successful completion of the purchase order.
San Carlo e-commerce platform does not retain or store any credit or debit card information.
- Shipping and Delivery
San Carlo will carry out the delivery of the products through specialized courier services. The Customer or an authorized representative must be present at the time of delivery to inspect the packaging integrity and verify that the products conform to the order.
In the event of visible defects, the Customer (or their representative) must report any issues on the delivery document and sign it.
The Customer must then promptly notify San Carlo at info@acquasancarlo.it to report the issue.
- Right of Withdrawal
Pursuant to Articles 52 et seq. of the Consumer Code, the Consumer Customer is entitled to withdraw from the purchase of product(s) within fourteen (14) days from the date of delivery, without the need to provide any justification and without incurring any costs, except for return shipping charges. The Consumer Costumer may use the standard withdrawal model in Annex 1, Part B, of the Consumer Code or send an explicit statement of the decision to exercise the right of withdrawal.
The notice of withdrawal must clearly indicate the product(s) to which it refers and may be submitted by Consumer Customer to San Carlo by one of the following means:

The right of withdrawal may be exercised in relation to all or only part of the purchased products.
The products must be returned by Consumer Customer within fourteen (14) days from the date the withdrawal notice is submitted, in their original packaging, together with any related documentation, to the following address (at the Consumer Customer’s expense):

Returned products must be intact, unopened, and in their original packaging.
Return shipping costs shall be borne by the Consumer Customer, unless the products are defective or incorrect.
San Carlo will process the refund within fourteen (14) days from the date of receipt of the returned products.
The right of withdrawal does not apply to products that have been opened, used, or partially or fully consumed, including bottles and/or boxes.
- Warranty
All products are covered by the warranty provided under the applicable Law, including, where relevant, the provisions of the Italian Civil Code and the Legislative Decree No. 206 of 6 September 2005 (the “Consumer Code”), in the case of Consumer Customers.
If a product is found to be defective, non-compliant, or damaged, the Customer is required to contact San Carlo at the addresses specified in Article 1 of these Terms and Conditions, providing suitable supporting documentation, including photographic evidence, to substantiate the claim.
- Force Majeure
Neither party shall be held liable for delays or failure to perform contractual obligations due to force majeure, including – but not limited to – natural disasters, war, terrorism, fire, floods, strikes, epidemics, pandemics, interruptions of public services, governmental actions, or any other event beyond reasonable control.
- Data Privacy
Personal data is processed in compliance with EU Regulation 2016/679 (GDPR).

- Applicable Law and Dispute Resolution
The contract between Customer and San Carlo shall be governed by the Italian Law.
In the event of any disputes arising between San Carlo and a Consumer Customer relating to the online sale of products via www.acquasancarlo.com, the Consumer shall have the right to access alternative dispute resolution (ADR) mechanisms in accordance with Articles 141 et seq. of Legislative Decree No. 206 of 6 September 2005 (the “Consumer Code”).
San Carlo informs Consumer Customers that they may access ADR services recognized and registered in the list maintained by the Ministry of Enterprises and Made in Italy, available at the following link:

In any event, the Consumer Customer has the right to initiate legal proceedings before the competent judicial Authorities.
Pursuant to Article 66-bis of the Consumer Code, jurisdiction shall lie with the Court of the Consumer’s place of residence or domicile, if it is located within the territory of Italy.
For Professional Customers, jurisdiction shall be determined in accordance with the applicable Law and provisions set forth in the Italian Code of Civil Procedure.
